Privacy Policy

Effective date: September 19, 2026
Last updated: September 19, 2026

Brownstein Enterprises respects your privacy. This Privacy Policy explains how Richard Brownstein, doing business as Brownstein Enterprises (“Brownstein Enterprises,” “we,” “us,” or “our”), collects, uses, retains, and discloses personal information through BrownsteinEnterprises.com and its related pages (the “Website”).

1. Scope and operator

This Policy applies to information handled through the Website, including information submitted through our contact form and our voluntary email-subscription forms. It does not govern the independent practices of third-party companies, affiliate programs, payment processors, or websites that you visit after leaving our Website.

The Website is owned and operated by Richard Brownstein, doing business as Brownstein Enterprises, in California, United States.

2. Personal information we collect

Information you provide

  • Contact information: your name and email address when you submit the Contact Form.
  • Communications: the message, question, and other information you choose to send us.
  • Email subscription information: your name, email address, subscription status, consent record, and related preferences if you voluntarily subscribe to a newsletter or marketing emails.
  • Business records: information reasonably necessary to document an inquiry, consent, opt-out request, complaint, or other interaction with Brownstein Enterprises.

Please do not send Social Security numbers, financial-account credentials, health information, government identification numbers, or other sensitive personal information through the Contact Form.

Information collected automatically

When you use the Website, our hosting, security, caching, and website systems may automatically process technical information such as:

  • Internet Protocol (IP) address;
  • browser, device, and operating-system information;
  • pages and files requested;
  • referring and destination addresses;
  • date and time of access;
  • general diagnostic, error, performance, and security information; and
  • cookie or similar technical identifiers required to operate and protect the Website.

We do not currently use advertising pixels or cross-site behavioral advertising technologies on the Website. If those practices change, we will update this Policy and implement any legally required notice, consent, or opt-out controls before using them.

Information from other sources

We may receive limited information from service providers that help operate the Website or deliver communications, such as delivery status, security alerts, form-submission records, subscription confirmations, and opt-out requests. We may also receive information you direct a third-party provider to send to us.

3. How we use information

We may use personal information to:

  • operate, maintain, secure, and troubleshoot the Website;
  • receive, evaluate, and respond to inquiries;
  • send requested information;
  • administer an email subscription and send marketing communications when you have elected to receive them;
  • honor unsubscribe, privacy, and other consumer requests;
  • detect, investigate, and prevent spam, fraud, misuse, security incidents, and unlawful activity;
  • maintain appropriate business, consent, and compliance records;
  • enforce our terms and protect our rights, users, and property;
  • comply with law, legal process, and lawful governmental requests; and
  • evaluate and improve the accessibility, reliability, and usefulness of the Website.

Information submitted through the Contact Form is used to answer the inquiry. Submitting a Contact Form does not subscribe you to recurring marketing emails.

4. Email communications

If we offer a newsletter or opportunity updates, subscription is voluntary. We use AWeber as our email-service provider to manage subscriptions, consent records, delivery, and opt-outs. We may use a confirmation email to verify that the person controlling the address requested the subscription.

Marketing emails will identify Brownstein Enterprises, provide a valid postal address, and include a working method to unsubscribe. You may unsubscribe at any time by using the link in an email. We may retain limited suppression information so that we can honor your request and avoid resubscribing the address inadvertently.

Opting out of marketing does not prevent us from sending a non-promotional response that you requested or a message necessary to address an existing transaction, legal matter, security concern, or privacy request.

5. Cookies and similar technologies

Cookies are small data files stored by a browser. The Website may use cookies and similar technologies that are reasonably necessary for security, administrator authentication, form operation, user preferences, caching, and reliable website delivery. Blocking necessary cookies may cause parts of the Website to function incorrectly.

We do not currently use cookies to sell personal information or serve cross-context behavioral advertising. Third-party websites reached through our links may use their own cookies and tracking technologies under their own policies. Brownstein Enterprises does not control cookies placed after you leave our Website.

Browser privacy signals

Some browsers offer “Do Not Track” settings. Because there is no uniform industry response to every such setting, the Website may not respond to all Do Not Track signals. We do not currently sell or share personal information for cross-context behavioral advertising. If we engage in a practice subject to a legally recognized opt-out preference signal, such as Global Privacy Control, we will process that signal as required by applicable law.

6. How we disclose information

We may disclose personal information only as reasonably necessary for the purposes described in this Policy:

  • Website and hosting providers: including D9 Hosting and WordPress-related systems used to host, deliver, back up, secure, and maintain the Website.
  • Form provider: Forminator/WPMU DEV technology used to operate and store Contact Form submissions within the WordPress environment.
  • Email providers: Proton Mail or another business email provider used to receive and respond to inquiries, and AWeber if you voluntarily subscribe to an email list.
  • Professional advisers: attorneys, accountants, insurers, auditors, and consultants when reasonably necessary and subject to appropriate duties of confidentiality.
  • Legal and safety recipients: courts, regulators, law enforcement, governmental authorities, or other parties when we reasonably believe disclosure is required by law or necessary to protect rights, safety, property, users, or the public.
  • Business-transition recipients: a prospective or actual purchaser, successor, or adviser involved in a merger, financing, reorganization, sale, or transfer of all or part of the business, subject to appropriate safeguards and applicable law.
  • At your direction: a recipient you authorize us to contact or provide information to.

Service providers may process information only for the services they provide and under their own contractual and legal obligations.

7. Affiliate links and third-party providers

The Website may contain links to independently operated companies and may receive compensation when a visitor follows an affiliate link or completes a qualifying transaction. A short affiliate disclosure will also be placed close to applicable recommendations or links.

When you click an external link, the destination company may receive information such as the referring page, device or browser details, IP address, and an affiliate or campaign identifier. The destination company may set its own cookies and will process information under its own privacy policy. Brownstein Enterprises does not control and is not responsible for an outside company’s privacy, security, payment, refund, fulfillment, or support practices.

Unless expressly stated otherwise, purchases are made from and processed by the applicable third-party provider, not Brownstein Enterprises. We encourage you to review the provider’s privacy policy and terms before submitting information or paying money.

8. Sale, sharing, and targeted advertising

Brownstein Enterprises does not sell or rent its mailing list. We do not currently sell personal information or share personal information for cross-context behavioral advertising as those terms are defined under California privacy law. We do not currently disclose personal information to third parties for their own direct-marketing purposes.

Using service providers to host the Website, deliver requested email, prevent fraud, or perform similar operational functions is not treated by us as selling the mailing list. If our practices change in a manner that creates a legal right to opt out, we will update this Policy and provide the required opt-out mechanism before implementing the change.

9. Retention

We retain information only for as long as reasonably necessary for the purpose for which it was collected and for legitimate security, recordkeeping, dispute-resolution, and legal needs. Current general retention standards are:

Information General retention approach
Contact Form inquiries and related correspondence Generally up to 12 months after the most recent substantive communication, unless a longer period is reasonably necessary for a dispute, transaction, security matter, or legal obligation.
Email subscription information For as long as the subscription remains active. After an opt-out, limited suppression and consent records may be retained as necessary to honor the request and demonstrate compliance.
Technical, security, and server logs According to operational, backup, fraud-prevention, security, and hosting-provider schedules, unless longer retention is reasonably necessary to investigate an incident or satisfy law.
Legal and compliance records For the applicable limitation, tax, accounting, regulatory, or dispute period.

Backup copies may remain for a limited period until overwritten through ordinary backup cycles. Information may be deleted, anonymized, or aggregated when it is no longer reasonably necessary.

10. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the Website and information involved. These measures may include access controls, account security, software maintenance, backups, secure connections, anti-spam measures, and reputable service providers.

No website, transmission, or storage system is completely secure. We cannot guarantee absolute security. You are responsible for using caution when deciding what information to send through an online form or email.

11. Your choices and privacy requests

Depending on where you live and the law that applies, you may have rights to request access to, correction of, or deletion of certain personal information; to receive information about collection and disclosure practices; to withdraw consent; or to opt out of certain uses or disclosures.

You may submit a request by emailing Richard@BrownsteinEnterprises.com or writing to the address in Section 18. Describe your request and the email address associated with your interaction. To protect privacy and prevent fraud, we may request information reasonably necessary to verify identity and authority. We will use verification information only for that purpose.

You may use an authorized agent where applicable. We may require evidence of the agent’s authority and may ask you to verify your identity directly unless applicable law provides otherwise. We will respond within the period required by applicable law. Some requests may be limited or denied where an exception applies, including where information is necessary for security, legal compliance, recordkeeping, free-expression rights, or the establishment or defense of legal claims.

We will not discriminate against you for exercising an applicable privacy right.

12. California privacy notice

This section supplements the rest of this Policy for California residents. California’s privacy laws apply differently depending on the nature and size of a business. Based on its current operations, Brownstein Enterprises does not represent that it meets the statutory thresholds applicable to every obligation under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”). Where a California requirement applies, we will comply with it.

Categories handled

During the preceding 12 months, we may have collected the following categories of personal information described in California law:

  • Identifiers: name, email address, IP address, and similar technical identifiers.
  • Internet or electronic activity: page requests, referring information, browser or device information, interaction, diagnostic, and security data.
  • Commercial or communication information: the content and history of an inquiry, subscription choice, and related business correspondence.
  • Inferences: limited conclusions reasonably apparent from a request, such as the topic in which a visitor expressed interest. We do not currently create advertising profiles for cross-context behavioral advertising.

We collect these categories from you, your browser or device, and the operational service providers described above. We use and disclose them for the purposes described in Sections 3 and 6.

We do not intentionally request sensitive personal information through the Website. We have not sold personal information or shared it for cross-context behavioral advertising during the preceding 12 months. We have not knowingly sold or shared personal information of consumers under 16.

California direct-marketing disclosure

California Civil Code section 1798.83 may permit certain residents to request information about disclosures of personal information to third parties for their own direct-marketing purposes. Brownstein Enterprises does not currently make such disclosures.

California online privacy disclosures

Third parties may collect information over time and across websites after you follow a link to a separately operated service. On the current Website itself, we are not aware of third-party advertising networks collecting personally identifiable information across different websites on our behalf. See Section 5 for information about browser privacy signals.

13. Children and age restrictions

The Website is intended for adults aged 18 or older and is not directed to children. We do not knowingly collect personal information online from children under 13. If we learn that we collected personal information from a child under 13 without legally sufficient authorization, we will take reasonable steps to delete it. A parent or guardian who believes a child supplied information may contact us using Section 18.

14. International visitors

Brownstein Enterprises is located in California, and the Website is currently directed primarily to adults in the United States. If you access it from another country, information may be processed and stored in the United States, where privacy laws may differ from those in your location.

We do not presently direct marketing specifically to residents of the European Economic Area, United Kingdom, or other foreign jurisdictions requiring additional frameworks. Before intentionally expanding into such markets or implementing behavior-monitoring technologies there, we will evaluate and implement applicable notice, consent, contractual, and data-subject-right requirements.

15. External websites

The Website contains links to external websites we do not own or control. A link does not mean that Brownstein Enterprises controls or guarantees the destination’s privacy practices, security, legality, accuracy, products, or services. Review the destination’s policies before providing information.

16. Changes to this Policy

We may revise this Policy when our Website, services, providers, or legal obligations change. The updated version will be posted on this page with a revised “Last updated” date. If required by law, we will provide additional notice or obtain consent before applying a material change.

17. Accessibility

If you need this Policy in an alternative format because of a disability, contact us using the information below. We will make reasonable efforts to provide an accessible version.
